Candidates may be eligible under humanitarian and compassionate (H&C) grounds even if they do not meet the requirements for permanent residence in Canada. You can request special permission to stay in Canada when you submit a Humanitarian and Compassionate (H&C) application by applying for permanent residence. Generally, an H&C is a last-ditch attempt to stay in Canada.

What is Humanitarian and Compassion (H&C)?

Humanitarian and Compassion (H&C) track is for exceptional cases only. There are other methods of applying for residence. Several factors determine whether an applicant can apply on humanitarian and compassionate grounds. Citizenship and Immigration Canada may grant permanent residency to an applicant on humanitarian and compassionate grounds by section 25 of the Immigration and Refugee Protection Act.
Other factors may qualify you, such as having worked in Canada for several years or having children born in Canada attending Canadian schools.   • Apply for humanitarian and compassionate assistance for one of the three immigration classes (economic class, family class, or refugee program) by completing the appropriate form and justifying your request.

How Much Time The Humanitarian & Compassionate Grounds Application Take?

The Humanitarian and Compassionate Foundations Program has a complex application process. In Canada, the application process for H&C can take an average of two to three years. If more applications are received, you may remain in the country while processing your application.

Documents Required For Humanitarian and Compassionate Application

The government may request the following documents as proof of your claims.

A letter from a relative expressing the depth of the bonds and how difficult it would be for them to be separated

A letter outlining your employment and providing proof of your monthly income from your current employer

A letter from a friend or community member emphasizing important social roles the candidate has played, such as their volunteer work and unique ties to the community.

An important point to remember is that each letter submitted must be handwritten, date stamped, signed by the author, and describe the nature of the relationship with the applicant.

If the applicant is a parent, the child can write a letter explaining why the applicant wants to stay in Canada, or the applicant can submit documentation about continuing the child's education in Canada (school activities, certificates of attendance, letters from friends and teachers, etc.)
